Accuracy and Warranties Index Snap SASU or any of its affiliates (“Index Snap”) (i) does not guarantee the adequacy, accuracy, timeliness, completeness, evolution and/or movements of its indices or any data included therein (the “Indices”), (ii) shall not have any liability for any errors, omissions, delays or interruptions therein and (iii) makes no warranty, express or implied, as to results to be obtained by owners of any securities, or by any other person or entity, deriving from the use of the Indices. Index Snap makes no express or implied warranties, and expressly disclaims, all warranties of merchantability or fitness for a particular purpose or use with respect to the Indices.
Regulatory Status and Compliance The Indices are not designed to comply with the European Undertakings for Collective Investment in Transferable Securities (UCITS) Directive and may not be suitable for funds subject to this regulation. Furthermore, the Indices are designated as non-significant benchmarks and, as such, Index Snap SASU will operate under the expected exemption from the full scope of the EU Benchmark Regulation (BMR) registration and authorization requirements, effective January 1st, 2026. None of the Indices are regulated benchmarks under BMR. The Indices are provided for general informational purposes only, and users must determine their suitability for regulatory purposes and legal eligibility.
Limitation of Liability Without limiting the foregoing, in no event shall Index Snap have any liability for any lost profits or indirect, punitive, special or consequential damages or losses, even if notified of the possibility thereof. Index Snap SASU will do everything in its power to ensure the accuracy of the composition, calculation, and publication of these Indices in accordance with the relevant rules.
